| After a seven-week trial in the United States District Court for the Central District of California, Thomas H. Bienert, Jr., Luis A. Feldstein, and Christi Coles of Bienert, Miller and Katzman (“BMK”) scored a major victory by securing a not-guilty verdict on all charges against their client, a doctor accused of Medicare fraud. The 75-count indictment had alleged that the doctor, along with three other doctors, had billed Medicare for respiratory treatments that either were never administered or were done so in violation of Medicare regulations. The 12-member jury unanimously decided that the government failed to prove that BMK’s client had any knowledge of the questionable billing practices. A second doctor also was acquitted, while the jury failed to reach a unanimous verdict on the other two doctors, resulting in a mistrial as to those defendants.

Kenneth Miller successfully argued in United States v. Sanchez, USCA No. 06-50329, that the District Court wrongfully denied the defendant's new trial motion. The Ninth Circuit reversed the District Court's order denying the new trial motion and remanded the case for further proceedings. |
